Pre-approved HSBC Credit Card Promotional Terms and Conditions

Eligibility

  1. The promotional period is from 9 November 2018 to 31 December 2018, both dates inclusive ("Promotional Period").
  2. This promotion is only applicable to designated customers. Designated customers must successfully apply for a primary card of Hong Kong dollar personal HSBC Visa Signature card, HSBC Visa Platinum card or HSBC Visa Gold card (each an “Eligible Credit Card”) issued by The Hongkong and Shanghai Banking Corporation Limited in Hong Kong (and its successors and assigns) (the “Bank" or “HSBC”) during the Promotional Period with successful approval and must use the Eligible Credit Card to fulfill the Spending Requirement (as defined in clause 7 below) or withdraw cash advance in order to be eligible for the Welcome Offer (as defined in clause 7 below) (together, ”Promotional Offers”) ("Eligible Cardholders").
  3. "Existing Credit Card Customers" refers to customers who possess a personal primary credit card issued by the Bank at the time being invited to apply for an Eligible Credit Card. "New Credit Card Customers" refers to customers who do not possess any personal primary credit card issued by the Bank at the time being invited to apply for an Eligible Credit Card.
  4. The date on which an Eligible Cardholder submits all required documents through HSBC website or HSBC Internet Banking will be based on the Bank’s record which shall be conclusive.
  5. Each Eligible Cardholder is entitled to receive only one Welcome Offer even if he/she applies for more than one Eligible Credit Card during the Promotional Period and uses more than one Eligible Credit Card to fulfil the Spending Requirement. If an Eligible Cardholder is entitled to other promotional offer under another concurrent promotion run by the Bank, he/she may only receive promotional offer(s) under one of the promotions at the Bank’s discretion.
  6. Employees of the Bank are not eligible for the Promotional Offers.

“Welcome Offer” - Up to $800 RewardCash Welcome Gift, as well as up to $1,000 RewardCash Rebate of Cash Advance Fee and Handling Fee

  1. Each Eligible Cardholder is entitled to receive the following welcome gift (each a "Welcome Gift") upon fulfilling the relevant spending requirement (“Spending Requirement”) specified below:

    Other than the choice of one of the above Welcome Gifts, each Eligible New Credit Card Customer is also entitled to the Cash Advance Fee and Handling Fee Rebate, details are as follows:

    Rebate of 2% Cash Advance Fee and 3% Handling Fee on the amount advanced within first 60 calendar days from the issuance of credit card* Up to $1,000 RewardCash

    * Cash Advance Fee of 2% plus Handling Fee of 3% on the amount of the advance is charged on the date of transaction for every cash advance transaction and is subject to a minimum charge. Eligible Cardholders can enjoy up to 56 days interest-free period. If the Bank receives payment of the statement balance in full on or before the payment due date, Eligible Cardholders do not have to pay any finance charge on that statement balance. If the Eligible Cardholders do not pay the statement balance in full on or before the payment due date, the Bank may charge, without prior notice, a finance charge even if the Eligible Cardholders have paid the minimum payment due in full. The finance charge will accrue daily and be calculated at the interest rate of 2.625% per month (i.e. at the following Annualised Percentage Rate (APR)). The APR for cash advance is 37.75% (inclusive of the 2% Cash Advance Fee and 3% Handling Fee). The APR is calculated using method specified in relevant guidelines issued by The Hong Kong Association of Banks, and is rounded up or down to the nearest two decimal places. An APR is a reference rate, which includes all applicable interest rates, fees and charges of the product, expressed as an annualised rate. For the avoidance of doubt, this offer does not exclude an Eligible Cardholder’s obligation to pay (i) any interest to be charged, and (ii) the principal amount required to be repaid by the cardholder, in relation to the cash advanced to the cardholder. Rebate amount will be credited in the form of RewardCash. For more details (including the APR for cash advance and the minimum charge of advance), please refer to the Key Facts Statement.
    1. Each Eligible Cardholder needs to conduct Eligible Transactions with the newly approved Eligible Credit Card for the specified Spending Requirement mentioned above within the first 60 calendar days from the issuance of the credit card. “Eligible Transactions” refer to any transaction conducted with an Eligible Credit Card within the first 60 calendar days from the issuance of the credit card and posted on the Bank’s system during the offer fulfilment period. Whether a transaction is an Eligible Transaction shall be determined at the sole and absolute discretion of the Bank. Cash advances, annual fees, finance charges, late charges, quasi cash transactions at non-financial institutions (including purchase of foreign currency, money orders and travelers cheques), quasi cash transactions at financial institutions (including purchase of merchandise and services from banks), telephone orders, fax orders, mail orders, wire transfers, betting and gambling transactions, tax payments, bill payments settled via HSBC Internet Banking, purchase and/or reload of stored value cards or e-Wallets (excluding Octopus automatic add-value transactions), transactions made to redeem items under “RewardCash e-Shop” and other programmes, autopay and recurring transactions, withdrawal amount under the Cash Instalment Plan or other instalment plans, unposted, cancelled or refunded transactions and transactions of additional card(s) will not qualify as Eligible Transactions for the promotion and will not be counted towards the Spending Requirement.
    2. Welcome Offer will be fulfilled in accordance with the schedule below:

      For RewardCash and Cash Advance Fee and Handling Fee Rebate,
      • ­The rebate will be credited to the newly approved Eligible Credit Card account. Terms and conditions of the RewardCash Programme apply.

Annual Fee Waiver

  1. Each customer who applies for an Eligible Credit Card according to the application process mentioned in clause 2 during the Promotional Period with successful approval can enjoy first two-year credit card annual fee waiver for the newly approved Eligible Credit Card and additional card(s) of such Eligible Credit Card under this promotion. The additional card(s) has/have to be applied under the same application form as that of the Eligible Credit Card in order to be eligible for the first two-year credit card annual fee waiver.

General

  1. Once the Welcome Gift selection is indicated on the credit card application form, it cannot be changed. If an Eligible Cardholder does not indicate the choice of the Welcome Gift or chooses more than one gift, the Bank will assign RewardCash as the Welcome Gift for such Eligible Cardholder.
  2. The Bank will determine the eligibility of Eligible Cardholders for the Welcome Offer based on the Eligible Cardholders’ transaction records held with the Bank. Eligible Cardholders who participate in the promotion must keep all original sales slips or relevant transaction records. In case of any disputes, the Bank reserves the right at any time during or after the Promotional Period to request an Eligible Cardholder to submit the relevant original sales slips and/or such further documents or evidence for inspection. All documents submitted to the Bank will not be returned.
  3. Only Eligible Cardholders whose Eligible Credit Card accounts are valid and in good standing during the entire fulfilment period will be eligible for the Welcome Offer, and the first two-year credit card annual fee waiver.
  4. Any fraud and/or abuse of any offer under this promotion or cancellation of any Eligible Credit Card within 13 months of opening of the Eligible Credit Card account will result in forfeiture of a cardholder's entitlement to the offer(s). The Bank reserves the right to deduct an amount equivalent to the value of any offer(s) awarded to a cardholder inappropriately pursuant to any fraud and/or abuse directly from the cardholder's account held with the Bank without prior notice.
  5. The Bank reserves the sole right to approve or decline any credit card applications, and the Bank is not obligated to provide reasons for declining any application.
  6. No person other than the Eligible Cardholder and the Bank will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provisions of these terms and conditions.
  7. In case of disputes arising out of this promotion, the decision of the Bank shall be final and conclusive.
  8. The Bank reserves the right to suspend and/or terminate granting any Promotional Offers, and/or to amend these terms and conditions at any time. The latest details of the Promotional Offers and the revised terms and conditions will be made available on our website as soon as practicable.
  9. These terms and conditions are subject to prevailing regulatory requirements.
  10. In case of discrepancies between the English and Chinese versions of these terms and conditions, the English version shall apply and prevail.
  11. These terms and conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"). Each of the Bank and the Eligible Cardholder submits to the non-exclusive jurisdiction of the courts of Hong Kong but these terms and conditions may be enforced in the courts of any competent jurisdiction.

  1. All primary card applicants must be Hong Kong Special Administrative Region residents and aged 18 or above.

  2. (Not applicable to HSBC Visa Gold Card for Students applicants) To be eligible for the credit card, primary card applicant's annual income must meet the following requirements: HSBC Visa Signature card - HK$480,000/assets of HK$600,000 or above; Visa Platinum card - HK$150,000 or above; Visa Gold card - HK$60,000 or above.

  3. HSBC Premier customers applying for HSBC Premier MasterCard® Credit Card must have at least HK$100,000 Total Relationship Balance excluding lending (subject to the Bank's discretion) within two months of application submission for the application to be processed with the details provided on this form. If you are unable to meet the requirement within two months your application will be withdrawn. For any queries, please call our HSBC Premier Hotline on (852) 2233 3322.

  4. HSBC Advance customers applying for HSBC Advance Visa Platinum card must have at least HK$100,000 Total Relationship Balance excluding lending (subject to the Bank's discretion) within two months of application submission for the application to be processed with the details provided on this form.   6. HSBC Advance customers will enjoy a perpetual annual fee waiver on the HSBC Advance Visa Platinum primary card and all additional credit cards by providing the Integrated Account number (HSBC Advance). For any queries, please call our HSBC Advance Hotline on (852) 2748 8333.

  7. Existing account holders of The Hongkong and Shanghai Banking Corporation Limited (the "Bank" and/or "HSBC") will be entitled to an annual fee waiver for the new primary card (and all combined additional cards) for a period specified by the Bank from time to time. The Bank reserves the right to terminate the credit card annual fee waiver when the relevant account at the Bank is closed and such termination will be effective without prior notice to the credit cardholder(s).

  8. If you wish to enjoy the Hong Kong Jockey Club Cash Voucher Purchase Facility, please contact any branch for arrangement.

  9. The participating merchants / brands and offers of the private label cards may change from time to time without prior notice. Please call HSBC Customer Service Hotline on (852) 2233 3000# for the latest participating merchants / brands and offers of the private label cards.

  10. Your new card provides free use of the ATM / EPS facility. A PIN for ATM transactions will be mailed to you after successful card activation. If you do not wish to have this service, please call HSBC Customer Service Hotline on (852) 2233 3000# for arrangement. Please note that without an ATM PIN, you will not be able to access the ATM/EPS facility (including the credit card cash advance function through ATM) or register the phonebanking service through ATM / HSBC Customer Service Hotline with the card.

  11. Phonebanking service can be registered via our HSBC Customer Service Hotline (852) 2233 3000# or at any HSBC ATM in Hong Kong using your ATM PIN as first time authentication.

  12. (Applicable to HSBC Premier MasterCard® Credit Card, HSBC Advance Visa Platinum Card, HSBC Visa Signature Card and HSBC Visa Platinum Card) Your new card provides free use of Visa payWave or MasterCard contactless payment function. You may use your card for contactless payment transactions, subject to transaction limits (including limit on each purchase and other limits) set by the Bank, Visa or MasterCard Worldwide or the merchant from time to time. For payment over the pre-defined transaction limit or if contactless payment is unavailable, you will still need to sign on the credit card sales slip in order to complete the transaction.

  13. If the whole amount of the statement balance is not received by the Bank on or before the payment due date, a finance charge will accrue daily at 2.625% per month (equivalent to an Annualized Percentage Rate (APR) of up to 36.43% on purchase and 37.75% on cash advance, inclusive of the handling and cash advance fees for all listed card types)*, and will be applied to (a) the unpaid statement balance, from the statement date immediately preceding the said payment due date until payment in full; and (b) the amount of each new transaction posted to your card account since that statement date, from the transaction date until payment in full.



    * The APR is calculated based on a set of assumptions as set out in the relevant guidelines as referred to in the Code of Banking Practice and the actual APR applied may be different. The APR may also be different for cards not offered in this application form. Please call HSBC Customer Service Hotline on (852) 2233 3000# for enquiries. 

  14. The Bank may, at its sole discretion, decide whether to approve your application, and whether to issue a Visa Platinum or Gold card. If your application is not approved, the Bank may issue to you a Visa Gold card (for Visa Platinum card applicants). If you wish to cancel your card, please call our HSBC Customer Service Hotline on (852) 2233 3000#.

  15. Applications from the Bank's staff will be subject to HSBC's staff policy.

  16. The remuneration for sales staff is determined based on the staff's overall performance with reference to a wide range of factors, and is subject to review from time to time, for the purpose of encouraging the building of deep, long-lasting and mutually valuable relationships with customers. It is not determined solely on financial performance.types.

  17.     2. an eWelcome Pack, will be sent to me/us via email or by post where the email delivery fails;
    3. the eWelcome Pack includes information regarding the credit card(s), the agreement or terms and conditions governing the provision and use of the credit card(s), the ATM Card Terms and Conditions, the RewardCash Programme Terms and Conditions and the Terms and Conditions for the Credit Card Interest-free Instalment Plan applicable to Personal Credit Card Cardholders; and
    4. contents of the eWelcome Pack may also be accessed at the Bank’s website.
    (b) I/We agree that:
    1. before I/we activate the credit card(s) I/we applied for, I/we will read the contents of the eWelcome Pack and in particular, the agreement or terms and conditions governing the provision and use of the credit card(s), the ATM Card Terms and Conditions, the RewardCash Programme Terms and Conditions and the Terms and Conditions for the Credit Card Interest-free Instalment Plan applicable to Personal Credit Card Cardholders;
    2. even if I/we do not obtain or read the terms and conditions , I/we will still be fully bound by them upon activating the card(s); and
    3. I/we will contact the Bank promptly to obtain the hard copies of the contents of the eWelcome Pack if I/we do not receive them by the time I/we receive the card(s).

  1. I/We understand that I/we may authorise a person in writing to collect my/our credit card(s) on my/our behalf. I/We agree that:
    1. each person collecting my/our card(s) has authority to sign ackNowledgement of receipt of the card(s) on my/our behalf; and
    2. I/we will be responsible for any misuse of the card(s) or other consequences arising from this arrangement.
  2. I/We agree that the Bank has the right to accept or reject this application without giving reasons.
  3. I/We understand that the Bank does not appoint any third parties to refer credit card application to it and hereby confirm that this application was not referred by a third party under beneficial arrangement.

  1. We may collect the data of customers and other individuals in connection with the purposes set out in this Notice. These customers and other individuals may include the following or any of them (collectively “you”, “your”):
    • applicants for banking or financial services;
    • persons giving or proposing to give guarantees or security for obligations owed to us;
    • persons linked to a customer or an applicant that is not an individual, including the beneficial owners and officers of that customer or applicant, or in the case of a trust, including the trustees, settlors, protectors and beneficiaries of the trust; and
    • other persons who are relevant to a customer’ s relationship with us.
  2. If the data requested by us is not provided, we may be unable to provide (or continue to provide) products or services to you or to the relevant customer or applicant linked to you.
  3. Data may be:
    1. collected from you directly, from someone acting on your behalf or from another source; and
    2. combined with other data available to members of the HSBC Group (“HSBC Group” and any “member of the HSBC Group” means HSBC Holdings plc and/or its affiliates, subsidiaries, associated entities and any of their branches and offices).

    3. creating and maintaining our credit and risk related models;
    4. assisting other financial institutions to conduct credit checks and collect debts;
    5. ensuring your ongoing credit worthiness and good standing;
    6. designing financial products and services (including insurance, credit card, securities, commodities, investment, banking and related products and services) for your use;
    7. marketing products, services and other subjects as described in paragraph (f) below;
    8. determining the amount of indebtedness owed to or by you;
    9. exercising our rights under contracts with you, including collecting amounts outstanding from you;
    10. meeting our obligations, requirements or arrangements or those of any member of the HSBC Group, whether compulsory or voluntary, to comply with or in connection with:
      1. any law, regulation, judgment, court order, voluntary code, sanctions regime, within or outside the Hong Kong Special Administrative Region (“Hong Kong”) existing currently and in the future (“Laws”) (e.g. the Inland Revenue Ordinance and its provisions including those concerning automatic exchange of financial account information);
      2. any guidelines, guidance or requests given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers within or outside Hong Kong existing currently and in the future (e.g. guidelines, guidance or requests given or issued by the Inland Revenue Department including those concerning automatic exchange of financial account information) and any international guidance, internal policies or procedures;
      3. any present or future contractual or other commitment with local or foreign legal, regulatory, judicial, administrative, public or law enforcement body, or governmental, tax, revenue, monetary, securities or futures exchange, court, central bank or other authorities, or self-regulatory or industry bodies or associations of financial service providers or any of their agents with jurisdiction over all or any part of the HSBC Group (together the “Authorities” and each an “Authority”) that is assumed by, imposed on or applicable to us or any member of the HSBC Group; or
      4. any agreement or treaty between Authorities;
    11. complying with any obligations, requirements, policies, procedures, measures or arrangements for sharing data and information within the HSBC Group and/or any other use of data and information in accordance with any programmes for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful activities;
    12. conducting any action to meet our obligations or those of any member of the HSBC Group to comply with Laws or international guidance or regulatory requests relating to or in connection with the detection, investigation and prevention of money laundering, terrorist financing, bribery, corruption, tax evasion, fraud, evasion of economic or trade sanctions and/or any acts or attempts to circumvent or violate any Laws relating to these matters;
    13. meeting our obligations or those of any member of the HSBC Group to comply with any demand or request from the Authorities;
    14. enabling actual or proposed assignee(s) of all or any part of our business and/or assets, or participant(s) or sub-participant(s) of our rights in respect of you to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation and enabling the actual assignee(s) to use your data in the operation of the business or rights assigned; and
    15. any other purposes relating to the purposes listed above.
Disclosure of Data Disclosure of Data
  1. Data held by us or a member of the HSBC Group will be kept confidential but we or a member of the HSBC Group may provide data to the following parties or any of them (whether within or outside Hong Kong) for the purposes set out in paragraph (d) above:
    1. any agents, contractors, sub-contractors or associates of the HSBC Group (including their employees, officers, agents, contractors, service providers and professional advisers);
    2. any third party service providers who provide services to us or any member of the HSBC Group in connection with the operation or maintenance of our business (including their employees and officers);
    3. any Authorities;
    4. any persons under a duty of confidentiality to us or a member of the HSBC Group which have undertaken to keep such data confidential;
    5. the drawee bank providing a copy of a paid cheque (which may contain data about the payee) to the drawer;
    6. any persons acting on your behalf whose data are provided, payment recipients, beneficiaries, account nominees, intermediary, correspondent and agent banks, clearing houses, clearing or settlement systems, market counterparties, upstream withholding agents, swap or trade repositories, stock exchanges, companies in which you have an interest in securities (where such securities are held by us or any member of the HSBC Group) or any persons making any payment into a customer’s account;
    7. credit reference agencies, and, in the event of default, to debt collection agencies;
    8. any persons to whom we are or any member of the HSBC Group is under an obligation or required or expected to make disclosure for the purposes set out in, or in connection with, paragraph (d)(x), (d)(xi) or (d)(xii) above;
    9. any actual or proposed assignee(s) of ours or participant(s) or sub-participant(s) or transferee(s) of our rights in respect of you;
    10. any persons giving or proposing to give a guarantee or security to guarantee or secure your obligations to us; and
      1. any member of the HSBC Group;
      2. third party financial institutions, insurers, credit card companies, securities and investment services providers;
      3. third party reward, loyalty, co-branding and privileges programme providers;
      4. co-branding partners of ours or any member of the HSBC Group (the names of such co-branding partners will be provided during the application process for the relevant products and services, as the case may be);
      5. charitable or non-profit making organisations; and
      6. external service providers that we or any member of the HSBC Group engage(s) for the purposes set out in paragraph (d)(vii) above.

Such data may be transferred in and to a place outside Hong Kong.

Provision of Data to Credit Reference Agencies (CRA) and Debt Collection Agencies Provision of Data to Credit Reference Agencies (CRA) and Debt Collection Agencies
  1. We may provide the following data relating to you (whether in sole name or joint names with others) to a CRA:
    1. full name;
    2. capacity in respect of each mortgage (as borrower, mortgagor or guarantor);
    3. Hong Kong Identity Card Number or travel document number or certificate of incorporation number;
    4. date of birth or date of incorporation;
    5. correspondence address;
    6. mortgage account number in respect of each mortgage;
    7. type of the facility in respect of each mortgage;
    8. mortgage account status in respect of each mortgage (e.g. active, closed, write-off); and
    9. if any, mortgage account closed date in respect of each mortgage.
    The CRA will use the above data for the purposes of compiling a count of the number of mortgages from time to time held by you (as borrower, mortgagor or guarantor, whether in sole name or joint names with others) for sharing in the consumer credit database of the CRA by credit providers.
  2. You can instruct us to make a request to the relevant CRA to delete from its database any account data relating to any credit that has been terminated by full repayment provided that there has not been, within five (5) years immediately before such termination, a default in payment under the credit for a period in excess of sixty (60) days according to our records.
  3. If there is any default in payment, unless the amount in default is fully repaid or written off (other than due to bankruptcy order) before the expiry of sixty (60) days from the date of default, your account repayment data may be retained by the CRA until the expiry of five (5) years from the date of final settlement of the amount in default.
  4. In the event of any amount being written off due to a bankruptcy order being made against you, the CRA may retain your account repayment data until the earlier of (i) the expiry of five (5) years from the date of final settlement of the amount in default, or (ii) the expiry of five (5) years from the date of your discharge from bankruptcy as notified to the CRA by you with evidence.
  5. For the purposes of paragraphs C and D above, account repayment data are the amount last due, amount of payment made during the last reporting period, remaining available credit or outstanding balance and default data (being amount past due and number of days past due, date of settlement of amount past due, and date of final settlement of amount in material default (that is, default in payment for a period in excess of sixty (60) days) (if any)).
Use of Data in Direct Marketing Use of Data in Direct Marketing
  1. Where you are a customer, we intend to use your data in direct marketing and we require your consent (which includes an indication of no objection) for that purpose. Please note that:
    1. your name, contact details, products and other service portfolio information, transaction pattern and behavior, financial background and demographic data held by us from time to time may be used by us in direct marketing;
    2. the following classes of products, services and subjects may be marketed:
      1. financial, insurance, credit card, banking and related products and services;
      2. reward, loyalty, co-branding or privileges programmes and related products and services;
      3. products and services offered by our co-branding partners (the names of such co-branding partners will be provided during the application for the relevant products and services, as the case may be); and
      4. donations and contributions for charitable and/or non-profit making purposes;
    3. the above products, services and subjects may be provided by or (in the case of donations and contributions) solicited by us and/or:
      1. any member of the HSBC Group;
      2. third party financial institutions, insurers, credit card companies, securities and investment services providers;
      3. third party reward, loyalty, co-branding or privileges programme providers;
      4. co-branding partners of ours or any member of the HSBC Group (the names of such co-branding partners will be provided during the application of the relevant products and services, as the case may be); and
      5. charitable or non-profit making organisations;
    4. in addition to marketing the above products, services and subjects ourselves, we may provide the data described in paragraph (f)(i) above to all or any of the persons described in paragraph (f)(iii) above for use by them in marketing those products, services and subjects, and we require your written consent (which includes an indication of no objection) for that purpose; and
    5. we may receive money or other property in return for providing the data to the other persons in paragraph (f)(iv) above and, when requesting your consent or no objection as described in paragraph (f)(iv) above, we will inform you if we will receive any money or other property in return for providing the data to the other persons.

If you do not wish us to use or provide to other persons your data for use in direct marketing as described above, you may exercise your opt-out right by notifying us.

  1. Where you provide to us data about another person, you should give to that person a copy of this Notice and, in particular, tell him/her how we may use his/her data.

  1. You have the right:
    1. to check whether we hold data about you and to access such data;
    2. to require us to correct any data relating to you which is inaccurate;
    3. to ascertain our policies and practices in relation to data and to be informed of the kind of data held by us; and
    4. in relation to consumer credit, to be informed on request which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of an access and correction request to the relevant credit reference agency or debt collection agency.
  2. In accordance with the provisions of the Ordinance, we have the right to charge a reasonable fee for the processing of any data access request.
  3. You should send requests for access to data or correction of data or for information regarding policies and practices and kinds of data held to:

  4. We may have obtained a credit report on you from a credit reference agency in considering any application for credit. In the event you wish to access the credit report, we will advise the contact details of the relevant credit reference agency.
  5. Nothing in this Notice shall limit your rights as a data subject under the Ordinance.

Note: In case of discrepancies or inconsistencies between the English version and the Chinese version, this English version shall prevail.

Major Terms and Conditions of Credit Card Cardholder Agreement

The Agreement applies to Premier MasterCard, Advance Visa Platinum, Visa Signature, Visa Platinum, Visa Gold, US$ Visa Gold, Gold MasterCard, Visa Classic and Classic MasterCard credit cards issued by us.

Your significant liabilities and obligations under the Agreement are summarised below for your particular attention. You should read the full version of the Agreement (which will prevail in the event there is any inconsistency with the following). By using (which includes activating) your card, you will be considered to have accepted the Agreement and will be bound by it. The terms used in this document are defined at the end.

  1. You should not transfer your card or PIN or allow any other person to use your card or PIN. You should sign your card as soon as you receive it.
  2. Except as referred to in paragraph (s) below, you are responsible for the card account and all card transactions (including all related fees and charges). You are responsible even if:
    1. you do not sign a sales slip (including where a card transaction may be effected by telephone, mail, electronic means or direct debit arrangement without a sales slip or without your signature) or the signature on the sales slip is different from the signature on your card;
    2. the card transaction is effected involuntarily; or
    3. you have any dispute with any merchant involved in a card transaction.
  3. You are required to comply with the credit limit on your card. We may reject card transactions in excess of the credit limit. However, we also have discretion to allow such card transactions without notice to you, unless we have received and processed your request to opt out from our over-the-limit facilities. Even if we accept your opt-out request, certain card transactions in excess of the credit limit may still be allowed, including any card transaction which is not immediately processed by us or does not require our authorisation for effecting payment.
  4. If you do not pay the statement balance of your card in full on or before the payment due date, we may charge, without prior notice, a finance charge even if you have paid the minimum payment due in full. If you do not pay the minimum payment due in full on or before the payment due date, we may charge, without prior notice, a late charge in addition to the finance charge. We may vary the fees and charges from time to time. Our "Bank tariff guide for HSBC Retail Banking and Wealth Management Customers" has details of various fees and charges including the applicable rates or amounts. That guide is available at our website or upon request at any of our branches in Hong Kong.
  5. You should notify promptly our Card Centre of any transaction shown in any card statement that was not authorised by you. You should notify us within 60 days of the date of the statement and in such manner as we may accept from time to time. If you do not notify us within the specified period, the transactions shown on the statement will be considered as correct, conclusive and binding on you and you will be deemed to have waived any right to raise any objection or pursue any remedies against us in relation to such transactions.
  6. All payments to us under or in connection with the Agreement (including the outstanding balance in your card account, interest, fees and charges) must be paid in full. You will not deduct any sums owed by us to you from any payments made or to be made by you under or in connection with the Agreement. If a deduction on account of tax or a similar charge or any other reason is required by applicable laws or regulations, or we are later obliged under applicable laws or regulations to return any money received by us in payment of the amount owing, you must make up the payment so that we receive the full amount owing under or in connection with the Agreement. You will upon our request, deliver promptly evidence satisfactory to us that you have complied with applicable deduction or withholding obligations. You hold us harmless and agree to fully indemnify us on demand for all consequences of any failure to comply with such obligations including any claim which may be made against us by any authorities.
  7. If you are the primary cardholder, you will be liable for the use of your primary card as well as the use of each additional card. We have full discretion in recovering indebtedness (including all fees and charges) incurred by an additional cardholder from the primary cardholder or that additional cardholder or both. If you are an additional cardholder, you will not be liable for the use of any additional card issued to another additional cardholder or the use of the primary card.
  8. We are entitled to combine or consolidate the outstanding balance on your card account with the balance on any other account which you maintain with us without prior notice. If you are the primary cardholder, our right will extend to the outstanding balance on the card account of any additional cardholder. We are entitled to set off or transfer any money standing to the credit of any other account which you maintain with us in or towards settlement of your liability to us under the Agreement.
  9. We may terminate or suspend your card (whether the primary card or an additional card) at any time without giving you prior notice or any reason. You may terminate your card at any time. If you wish to terminate your card, you have to give us written notice and return to us your card and all additional cards, if any.
  10. Upon the termination of your card for any reason or upon your bankruptcy or death, the following amounts will become immediately due and payable in full to us:
    1. the outstanding balance on your card account; and
    2. the amount of any card transactions effected but not yet charged to your card account.
  11. If you fail to pay any amount to us when due or if you breach any terms or conditions of the Agreement, we may enforce our rights or pursue remedies to collect or recover any outstanding amount. We are entitled to employ agents or service providers for such purposes. You are required to indemnify and reimburse us for all reasonable amounts of costs (including legal fees) and expenses reasonably incurred by us in collecting or recovering any outstanding amount.
  12. Except as set out in paragraph (m) below, you will indemnify and reimburse (i) us, (ii) our agents and nominees, and (iii) our officers and employees and that of our agents or nominees for the following items which we or they may incur or suffer as a result of or in connection with your use of our or our providing equipment, facilities or services to you under the Agreement:
    1. all actions, proceedings and claims which may be brought by or against us or them; and
    2. all losses, damages and reasonable amounts of costs and expenses.
    The indemnity shall continue after the termination of the Agreement.
  13. If it is proved that any actions, proceedings, claims, losses, damages or amounts set out in paragraph (l) above was caused by gross negligence or wilful default of (i) ours, (ii) our agents or nominees, or (iii) our officers or employees or that of our agents or nominees, then you are not liable under paragraph (l) above to the extent that it is direct and reasonably foreseeable arising directly and solely from such gross negligence or wilful default.
  14. We may separately issue or vary additional terms and conditions relating to card benefits from time to time. The terms and conditions relating to a card benefit set out the eligibility criteria, conditions, limits, guidelines or directions applicable to that card benefit.
  15. You should not use your card for payment of any gambling or other transaction which is illegal under any applicable laws.
  16. We have the right to vary the terms and conditions of the Agreement, interest rates, finance charges or other fees or charges from time to time. We will give you prior notice in a manner we consider appropriate. You will be bound by a variation unless your card is returned to us for termination before the date on which that variation takes effect.
  17. You agree to inform us promptly and in any event, within 30 days in writing if there are any changes to Your Information supplied to us or a member of the HSBC Group from time to time, and to respond promptly to any request for Your Information from us or a member of the HSBC Group.
  18. If your card is a Hong Kong dollar card and you effect a card transaction in a currency other than Hong Kong dollar, we will debit that card transaction to your card account after conversion into Hong Kong dollar. The exchange rate will be determined by us by reference to the exchange rate adopted by Visa or MasterCard Worldwide (as applicable) on the date of conversion. We will also debit to your card account a percentage of the card transaction charged by us and any transaction fee (in full or in part) charged by Visa or MasterCard Worldwide to us. The same arrangement applies to a card transaction effected by you in a currency other than US dollar if your card is a US dollar card.
  19. You should safeguard your card and PIN by taking appropriate security measures. You should promptly report any loss, theft, disclosure or unauthorised use of your card or PIN. You will be liable for all cash advances and all other transactions effected by unauthorised use of your card or PIN before we or any member of Visa or MasterCard Worldwide (as applicable) receive report of loss, theft, disclosure or unauthorised use. If you report loss, theft, disclosure or unauthorised use of your card or PIN in accordance with the Agreement, your maximum liability for unauthorised transactions (other than cash advances) is HK$500 per card.
  20. However, please note that the limits referred to in paragraph (s) above DOES NOT APPLY (and you will be liable for the full amount) in the cases below:
    1. if you have knowingly (whether or not voluntarily) permitted any other person to use your card or PIN; or
    2. if you have acted fraudulently or with gross negligence in using or safeguarding your card or PIN. Your failure to follow any of the security measures recommended by us from time to time regarding the use or safekeeping of your card or PIN may be treated as your gross negligence.

The English version of this document prevails to the extent of any inconsistency between the English and the Chinese versions. Any Chinese version of this document is for reference only.

Definitions Definitions

ATM means an automated teller machine.

Connected Person means a person or entity (other than you) whose information (including Personal Data or Tax Information) is provided by you, or on your behalf, to any member of the HSBC Group or which is otherwise received by any member of the HSBC Group in connection with the provision of the Services. A Connected Person may include any guarantor, a director or officer of a company, partners or members of a partnership, any "substantial owner", "controlling person", or beneficial owner, trustee, settlor or protector of a trust, account holder of a designated account, payee of a designated payment, your representative, agent or nominee, or any other persons or entities with whom you have a relationship that is relevant to your relationship with the HSBC Group.

HSBC Group means HSBC Holdings plc, its affiliates, subsidiaries, associated entities and any of their branches and offices (together or individually), and member of the HSBC Group has the same meaning.

Personal Data means any information relating to an individual from which such individual can be identified.

PIN means personal identification number or any code or number that is used by us to identify you when you access information, give instructions or make a transaction using a card, internet banking, phonebanking or any other service.

Services includes (a) the opening, maintaining, closing and terminating of your accounts or cards (including additional cards), (b) the provision of credit facilities and other banking products and services, processing applications, credit and eligibility assessment, and (c) maintaining our overall relationship with you, including marketing services or products to you, market research, insurance, audit and administrative purposes.

Tax Information means documentation or information about your tax status or the tax status of a Connected Person.

UnionPay ATM means any ATM bearing the logo of China UnionPay Company Limited that accepts your card.

Your Information means all or any of the following items relating to you or that of a Connected Person, where applicable: (i) Personal Data, (ii) information about you, your accounts, cards (including additional cards), transactions, use of our products and services and your relationship with the HSBC Group and (iii) Tax Information.
