Well+ “Live the Fitness” Lucky Draw Promotion (“Promotion”)

(A) General Terms and Conditions

1. The Promotion is offered by The Hong Kong and Shanghai Banking Corporation Limited (“HSBC”), runs from 25 Sep 2023 to 8 Oct 2023, both days inclusive (the “Promotion Period”) and is subject to the Terms and Conditions stipulated in Sections (A) General Terms and Conditions and (B) Lucky Draw herein.
2. The Promotion is available to customers of The Hongkong and Shanghai Banking Corporation Limited (and its successors and assigns) (“HSBC” or the “Bank”), incorporated in the Hong Kong Special Administrative Region (“Hong Kong SAR” or “Hong Kong”) with limited liability.
3. All participants must fulfil all of the following criteria [3a-e] (an “Eligible Customer”) below in order to join the Lucky Draw Promotion:
   1. be aged 17 or above on or before 25 Sep 2023; AND
   2. join the Well+ wellness reward programme (“Well+” or “the Programme”) during the Promotion Period; AND
   3. be a resident of Hong Kong with a valid Hong Kong Identity Card; AND
   4. have a valid email under the Bank’s record; AND
   5. have a valid mobile under the Bank’s record
      
      Any person who does not fulfil all the above required criteria will NOT be eligible to participate in the Promotion.
4. No person other than the Eligible Customer and HSBC will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong SAR) to enforce or enjoy the benefit of any of the provisions of these general terms and conditions.
5. In case of any dispute arising from the Promotions, the decision of HSBC shall be final and conclusive.
6. The invalidity, illegality or unenforceability of any of these Terms and Conditions shall not affect the remainder of these Terms and Conditions, which shall remain in full force and effect.
7. The terms and conditions in both section (A) and section (B) are governed by and construed in accordance with the Laws of Hong Kong SAR.
8. If there is any conflict between the information contained in the promotional materials and these terms and conditions, these terms and conditions shall apply and prevail.
9. If there is any inconsistency or conflict between the English version and the Chinese version of these general terms and conditions, the English version shall prevail.
10. These Terms and Conditions are to be read in conjunction with the Well+ Terms and Conditions, available on Well+ website at HSBC HK > Insurance > Well+ or on the HSBC HK Mobile Banking app. In the event of any conflict between these Terms and Conditions and the Well+ Terms and Conditions in respect of this Lucky Draw only, these Terms and Conditions shall prevail.

(B) Terms and Conditions of Lucky Draw

1. Each Eligible Customer will be eligible for the Lucky Draw automatically without further registration. Eligible Customers who complete Level 3 or above during the Promotion Period will have 3 lucky draw entries. The maximum no. of Lucky Draw entries for each Eligible Customer is 3. However, each Eligible Customer can win one Prize only.

2. Lucky Draw prizes (each a “Prize”) will be drawn randomly by computer, including:
   (a) Grand prize: Nintendo Switch Sports Game Software Bundle Set AND 2 Unlimited Class Pass (Single-day entry) of “The 3rd Edition of Hong Kong Fitness + Wellness Expo” (Quota: 1; Total value HK$3,018)
   (b) 2nd prize: 2 Unlimited Class Pass (Single-day entry) of “The 3rd Edition of Hong Kong Fitness + Wellness Expo” (Quota: 40; Total value HK$400)
   (c) 3rd prize: 2 General Admission tickets (Single-day entry) of “The 3rd Edition of Hong Kong Fitness + Wellness Expo” (Quota: 500; Total value HK$100)
   
   The results of the Lucky Draw performed by the computer provided by the Bank shall be final and no disputes in respect thereof shall be entertained.
3. An Eligible Customer's personal information in the Bank’s record must be valid during the Promotion Period and at the time of the Lucky Draw in order to receive the Prize.
4. The Lucky Draw Prizes will be sent on or before 25 Nov 2023 for Winners to his/her email (“Fulfillment Notice”) according to the Bank’s record at the time of email send. Winners can redeem the Prize according to the instructions stated in the Fulfillment Notice.
5. If the Winner of the Grand prize cannot be contacted (via the Winners valid email or mobile number recorded with the Bank) on or before the final date for collection stated in the Fulfillment Notice, and/or otherwise fails to collect the Grand prize before the final date for collection, the Bank reserves the right to allocate the Prize to another winner without any notice.
6. The Bank reserves the right to replace the Prize with any alternative gift without prior notice.
7. The Prize is not replaceable in the event of any loss or damage.
8. The Lucky Draw prize cannot be changed and/or exchanged for cash. The Lucky Draw prize is non-replaceable, non-refundable, non-transferrable and non-returnable.
9. Use of the Prize (or any alternative gift) may be subject to the suppliers’ terms and conditions applicable thereto. The Bank is not responsible for and shall have no liability in respect of the quality of goods and services provided by the suppliers of the Prize (or any alternative gift) in this Lucky Draw. The Bank is not responsible for any personal information submitted by the Winner directly to the supplier in the course of redeeming the Prize.
10. The Bank shall not be liable for any damages, losses, claims, costs or proceedings incurred or suffered by the Eligible Customers as a result of their participation of the Lucky Draw.
11. The Bank has the sole and absolute discretion in determining a person’s eligibility to receive the Prize. If the Bank discovers at any time, whether after or during the Promotional Period, that any person has failed to comply with these terms and conditions, the Bank is entitled to disqualify the person from participating in the Lucky Draw and receiving the Prize.
12. The Bank reserves the right to change these terms and conditions and terminate the Lucky Draw at any time without prior notice. The Bank accepts no liability for any such change or termination.
