Terms and Conditions of【Cathay Pacific/HSBC Hong Kong Sevens Tickets Giveaway: Your Chance to Cheer for the Local Team】

  1. These Terms and Conditions govern the Hongkong and Shanghai Banking Corporation Limited (the "Bank")’s giveaway lucky draw (the "Giveaway") which offers you the chance to win one pair of 3-day tickets to the Cathay Pacific/ HSBC Hong Kong Sevens (the "Prize"), and apply to you as far as the law permits – so please read them carefully.
  2. The promoter of this Giveaway is The Hongkong and Shanghai Banking Corporation Limited in the Hong Kong Special Administrative Region ("Hong Kong") (and its successors and assigns) (the "Bank.").
  3. This Giveaway is open to all persons that are:
    1. residents in Hong Kong; and
    2. natural persons (e.g. companies are not eligible to enter); and
    3. aged 18 years or over.
    Entrants who cease to fulfil any of these criteria after entering the Giveaway will also be disqualified, even if they met the criteria at the time of entry. The Giveaway is void where prohibited by law or otherwise in breach of applicable legislation or other provisions or where there is a conflict of interest. You cannot enter if you have been involved in setting up or running this Giveaway.
  4. The Giveaway will be held from 28 September 2022 to 11:59pm on 5 October 2022 (based on Hong Kong time and as determined by the time of receipt by the Facebook/ Instagram server):

Entrants will be entered into the Giveaway by providing an eligible answer (by reference to this clause and clause 21) (i.e. 🏃🦶🏉🥅) and tagging two friends in the "comments" section of "the Giveaway" post on the Bank's Facebook/ Instagram page to the question stated in "the Giveaway" post during the entry period mentioned in Clause 4 above. Any entry posted in the "comments" section of these Terms and Conditions will not be considered. There is no "right" or "wrong" answer, however, entrants need to submit the answer using emojis only. Entrants can submit one valid answer, but only one Prize can be won per entrant in the Giveaway. The Bank, in its sole discretion, determines whether or not any entry is valid. Only answers deemed as positive will be considered.
  6. The Giveaway is launched on two social media platforms and there will be a total of 10 winners (the "Winners") with 5 for each platform. Each Winner will receive two sets of 3-Day tickets of the Hong Kong Sevens. The Prize will be randomly drawn to the Winners from the pool of all qualifying entrants.
  7. To qualify for the Giveaway, entrants:
    • must be registered users of Facebook/ Instagram.
    • agree that this Giveaway is in no way sponsored, endorsed, or administered by, or associated with Facebook/ Instagram.
    • acknowledge that by participating in the Giveaway the entrants are providing their information to the Bank rather than to Facebook/ Instagram.
    • grant Facebook/ Instagram a complete release from liability associated with this Giveaway, to the extent permissible by law.
    • understand that there will be no alternative entry route available; therefore all entries for the Giveaway must be made via Facebook/ Instagram.
  8. To qualify for the Giveaway, no purchases of goods or services are necessary.
  9. Only one entry of the Giveaway is permitted per person and per Facebook/ Instagram account, and only one Prize can be won per entrant.
  10. The Winners will be personally responsible for any and all additional costs incurred above those covered by the Prize, including those relating to the acceptance and use of the Prize.
  11. The announcement of the Winners will be made on or before 10 October 2022 on the Bank's Facebook page and Instagram page.
  12. The Bank will contact the Winners by responding to their submission of entry in the "comments" section of "the Giveaway" post on Facebook/ Instagram. If no response is received from a Winner within a specified period of time, or if a Winner is found to be ineligible to enter this Giveaway, or if a Winner fails to provide the required information for identity verification or otherwise fails to follow the instructions of the Bank on Prize collection, the Winner will be disqualified and the Bank reserves the right to determine a replacement or forfeit the Prize. The Bank will provide the Winners with an email address via Facebook/ Instagram to contact the Bank. Each Winner will then be requested to verify his/her identity and collect the Prize according to the instructions stated in the Bank's emails.
  13. The Bank will deliver the Prize on or before 1 November 2022, to the information provided by the Winner. The Bank is not responsible for items that are lost, damaged or stolen in transit.
  14. There will be no cash, or part cash equivalent; the Prize is non-transferable, non-negotiable and non-refundable. In particular, prizes must not be sold or given away and may become void if this condition is breached. If the Prize offered is unavailable due to circumstances beyond the control of the Bank, the Bank reserves the right to substitute the Prize for one of equal or equivalent value. The Bank shall not be responsible for any expenses, inconvenience or costs incurred due to the delay, postponement or cancellation of any event.
  15. The Bank reserves the right to feature the Winners’ names on Facebook/ Instagram, and will make this information available from the Bank’s Facebook/ Instagram page on or after the 10 October 2022. By accepting the Prize, the Winner agrees to this use of his/her information.
  16. The Winners' personal data including Facebook/ Instagram account name, full name, mobile phone contact number and email address will be collected under this Giveaway and such personal data will only be used for this Giveaway programme. The personal data may be used by the Bank: (i) to contact an entrant if he/she wins the Giveaway; (ii) to verify an entrant’s eligibility for the Giveaway; (iii) to verify the identity of an entrant; (iv) to make an announcement of the Winners on Facebook/ Instagram; and (v) to administer and assess this Giveaway. The personal data collected will not be used to update the Bank’s record. The Bank will delete the collected data within 6 months after the fulfilment of the Prize. The Winners’ personal information may be passed to third parties as necessary for the fulfilment of the Prize.
  17. By providing his/her personal data to the Bank, a Winner agrees to the use of his/her personal data by the Bank for the purposes mentioned in these Terms and Conditions.
  18. Personal data will be collected by the Bank in accordance with the Bank's privacy policy (https://www.hsbc.com.hk/personal/legal-information.html. Any information that you provide on Facebook/ Instagram will be subject to Facebook's/ Instagram's privacy policy and procedures which can be accessed at https://www.facebook.com/privacy/explanation / https://www.Instagram.com/privacy/explanation).
  19. By entering this Giveaway, entrants agree to be bound by these Terms and Conditions. No correspondence will be entered into. In case of any dispute arising out of the Giveaway, the decision of the Bank shall be final and conclusive. All matters relating to the Giveaway shall be at the Bank’s sole discretion. The decision of the Bank is final and no enquiries, verbal or written, shall be entertained.
  20. No person other than the entrant and the Bank will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provisions of these Terms and Condition.
  21. The entries by the entrants are in their personal capacity. The opinions expressed in the entries are the entrants' own and do not reflect the view of the Bank. Entries containing any nudity or any other unsuitable material or are deemed to be defamatory, obscene, illegal, or offensive will be disqualified and removed by the Bank without advance notice.
  22. The Bank does not accept responsibility for entries that are lost, damaged, defaced, illegible, incomplete, incorrectly completed, delayed by any failure or malfunction of computer or software or by any failure or defect in any telephone network.
  23. The Bank reserves the right to exclude an entrant who violates these Terms and Conditions, tampers with the Giveaway, engages in abusive, deceit or fraudulent behavior in relation to the Giveaway or makes false representations or statements or violates applicable law or regulations. If an entrant is excluded, the Prize may be subsequently revoked and reclaimed.
  24. It is the Winners' responsibility to comply (at their own expense) with any laws requiring payment of any tax, duty, levy or similar impost relating to the award of the Prize, and the Bank shall have no responsibility in respect thereof.
  25. These Terms and Conditions are subject to prevailing regulatory requirements.
  26. EEntrants agree that this Giveaway programme and these Terms and Conditions shall be construed and governed in accordance with the laws of Hong Kong, and that the courts of Hong Kong shall have exclusive jurisdiction over any disputes.
  27. The Bank reserves the right to change these Terms and Conditions at any time without prior notice and the Bank accepts no liability for any such change, withdrawal and termination. This Giveaway programme may be withdrawn or terminated by the Bank at its discretion in which case the Bank will notify you in the 'comments' section of the Bank's Facebook/ Instagram page and/or via email.
  28. In the event of any discrepancy or inconsistency between the English version and the Chinese version of these Terms and Conditions, the English version shall apply and prevail.
